States with Salary Minimums Above FLSA

States where an employee must earn more than the Federal FLSA minimum of $35,568 per year to be exempt from overtime

FLSA requires that employees be paid at least $35,568 per year to be exempt from overtime. Many white collar positions must also meet certain duties tests to ensure that they also have discretion over their schedules to meet the exemption.


Alaska, California, Colorado, Maine, New York, and Washington have minimum salaries higher than the Federal standard to be considered exempt. See the table below for additional details.

$54,080/year (effective July 1, 2025)

Workers who are exempt from overtime requirements under Alaska Statute 23.10.055(b) must earn $1,040.00/week beginning July 1, 2025.

$68,640/year (effective January 1, 2025)

Employees in California must earn an annual salary of no less than $68,640 to meet this threshold requirement.

$56,485/year (effective January 1, 2025)

Being salaried alone isn't enough to be exempt from overtime. To be exempt, executives, administrators, and professionals must perform certain job duties and meet a minimum salary requirement of $56,485 per year. The minimum salary requirement increases annually. Employers don’t have to pay these salaries but can instead choose to pay hourly with overtime or adjust schedules to avoid extra hours.

$43,951/year (effective January 1, 2025)

As of January 1, 2025, the threshold will be $43,951 per year or $845.21 per week.

New York State $60,405.80/year

 

New York City, Nassau, Suffolk, and Westchester Counties $64,350 (effective January 1, 2025)

On  January 1, 2025, the state minimum weekly salary for administrative and executive employees will range from $1,161.65 per week for employees in New York State, to $1,237.50 per week for employees who work in Nassau, Suffolk and Westchester counties and in New York City for any size employer and Fast Food Establishments.

  • >50 employees $77,968.80/year (effective January 1, 2025)

  • 2025 salary thresholds ƒ

    • Small businesses: $1,332.80/week ($69,305.60 a year) ƒ

    • Large businesses: $1,499.40/week ($77,968.80 a year)

  • The salary thresholds are adjusted annually based on the Consumer Price Index.

  • Separate rules apply to computer professionals paid by the hour who have higher minimum wage multipliers.
